These terms of use (the "Terms of Use") apply to how you use our "SHOPHUB" mobile and portable application and our website, tecHangout.com/shophub. The term "Platform" refers to both the website and the application. Before using the services, please carefully read these Terms of Use. We ask that you uninstall the App and refrain from using the Platform's services if you disagree with these Terms of Use. By installing, downloading, or simply using the ShopHub platform, you agree to ShopHub's Terms of Use and other policies (like the Cancellation & Refund Policy, Privacy Policy, etc.). These policies are updated on the platform occasionally, and your acceptance takes effect when you download, install, or use the platform. This creates a legally binding agreement to follow these rules. The platform is meant for 

(i) individuals who are 18 years or older and 

(ii) legal business entities, such as companies. In some cases, country-specific rules may also apply.

Use Of Platform And Services

Buyers and merchants propose and accept all business and contractual terms solely. Commercial or contractual conditions include but are not limited to price, taxes, shipping charges, payment methods, terms of payment, date, period, and manner of delivery, product and service warranties, and post-purchase services. Does SHOPHUB not influence, decide, counsel, or participate in the offering or accepting such business or contractual terms between the merchants and buyers? However, in accordance with separate agreements it has signed with the merchants, SHOPHUB may provide support services to merchants in the areas of order fulfillment, payment collection, call center, and other services. Any non-performance or violation of a contract between buyers and merchants on the Platform is not SHOPHUB's responsibility.   ShopHub cannot guarantee that Buyers or Merchants will complete any transaction made on the platform. ShopHub is not responsible for poor service, failure to provide services, or issues like delays or damages caused by products that are out of stock, unavailable, or on backorder.

SHOPHUB is an e-commerce platform operator that facilitates all transactions between buyers and merchants on the platform. It never enters into or takes custody of any goods or services the merchant offers. SHOPHUB will never have any ownership, rights, or interests in the products, nor will it ever be held responsible for any debts resulting from the agreement between the buyer and the merchant. You understand and agree that we won't be held accountable for: 

• The goods provided by shops or restaurants include but are not limited to fulfilling food orders per your needs.

• The merchant's products do not meet your expectations or cause any loss, harm, or damage.

• The availability or unavailability of specific items on the menu.

• The merchant is delivering incorrect orders.

The product details and price lists available on the platform are based on information provided by the merchants. We are not liable for any changes, cancellations, or unavailability. All product images on our platform are for representation only and may differ from the actual menu or products ordered. SHOPHUB is not responsible for any discrepancies or variations in this regard. 

Your Submitted Personal Details

You must register for an account on our website to utilize our service. We will request personally identifying information, such as your name, phone number, and email address, to create your account. This information may be used to contact or identify you. In addition to allowing you to submit more data that will be included in your profile, we might also gather demographic data about you, such as your zip code. Aside from the fundamental details we require to create your account, you will be in charge of determining how much information you want to include in your profile. We advise you to protect your identity and sensitive information and urge you to be cautious about the information you disclose. Naturally, you are always free to check and edit your profile. 

You know that the shipping dates you were given when you confirmed your order are only estimates and could change. We will not be held accountable for any delays in order delivery resulting from order processing delays at the seller's or merchant's end or any other unforeseen circumstances.

Only the address you provided when placing your order on the Platform will receive your order. If the delivery location changes, we reserve the right to cancel the order at our sole discretion, and you won't be eligible for a refund. Delivery will be made at our sole discretion, and we have the right to impose an additional delivery cost if necessary. 

You agree to provide clear directions, information, and authorizations to ensure successful delivery. If delivery is unsuccessful due to your failure to provide the necessary instructions or authorizations, the goods will be considered delivered, with all risk and responsibility transferred to you. In such cases, no refund will be issued. Our decision in this matter will be final and binding. You acknowledge that our liability ends once your order has been delivered. 

When making a payment, you could be asked to provide your credit or debit card information to the authorized payment gateways. To use the services, you consent to give the authorized payment gateways your true and accurate credit or debit card information. You must use your own credit or debit card for all transactions; you are not allowed to use one that is not legally yours. The information you provide will not be shared with any third party unless required for fraud verification or by law, regulation, or court order. You are solely responsible for the security and confidentiality of your credit/debit card details. We disclaim any liability arising from the unauthorized use of your credit/debit card. You agree that our services will only be available during the working hours of the respective merchants. 

Activities Prohibited On The Platform

A brief list of the kinds of conduct that are prohibited or unlawful on the websites is provided below. SHOPHUB maintains the right to investigate and take appropriate legal action against anyone who commits any of the banned conduct. Though they are not the only ones, the following behaviors are forbidden:

• Using the websites for any unlawful purposes or violating applicable laws and regulations.

• Posting content infringing on the intellectual property, privacy, publicity, trade secret rights, or any other party's rights.

• Posting content that is illegal, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any person or entity, as determined by SHOPHUB at its sole discretion or according to local community standards.

• Posting content that constitutes cyberbullying, as determined by SHOPHUB at its sole discretion.

• Posting content that portrays dangerous, life-threatening, or otherwise risky behavior.

• Posting personal information such as telephone numbers, street addresses, or last names of individuals.

• Posting URLs to external websites or any form of HTML or programming code.

• Posting anything deemed "spam" by SHOPHUB at its sole discretion.

• Impersonating another individual while posting content.

• Harvesting or collecting information about others, including email addresses, without their consent.

• Allow any other individual or entity to use your account to post or view comments.

• Harassing, threatening, stalking, or abusing anyone.

• Engaging in any conduct that restricts or inhibits others from using or enjoying the websites or that, in the sole discretion of 6valley, exposes eFood or any of its customers, suppliers, or other parties to any liability or harm.

• Encouraging others to participate in any prohibited activities as outlined herein.

SHOPHUB may choose to do any or all of the following, but is not required to: 

• Examine a claim that any content on the websites violates these terms of use and, at its discretion, decide whether to remove the content or ask that it be removed.

• Eliminate any content that violates these terms of use or is disruptive, abusive, or unlawful.

• Stop a user from using the websites if they violate these terms of use.

• Keep an eye on, modify, or reveal any website content.

• Any content placed on the websites may be edited or removed, even if it doesn't adhere to these guidelines. 

Amendments

These Terms may be altered at any time by SHOPHUB, which will post such modifications on the Platform. We strongly advise you to read these terms on a frequent basis. If you continue to use the Platforms after the date the new Terms are posted, it will be assumed that you have accepted the updated Terms.

Payment

SHOPHUB retains the right, in its sole discretion, to remove current payment options and/or offer new ones at any moment. If you decide to pay online, our third-party payment service provider(s) will handle the payment processing. Your credit card and payment details will be kept on file with our third-party payment service provider or providers with your permission for upcoming orders. SHOPHUB does not store your payment details and credit card information. 

Ensure you have enough money on your debit and credit cards to complete an order payment. If fair, justified, and in compliance with these Terms, SHOPHUB assumes responsibility for payments made on our platforms, including refunds, chargebacks, cancellations, and dispute resolution. 

Cancellation

Due to the unavailability of goods or items, being outside of the coverage region, or any other unforeseen situations, SHOPHUB reserves the right to cancel any order at any moment.
